Pharmaceutical Terms

“Pharmaceutical Terms” apply to the fulfilment of prescriptions for the products by Quest HC Ltd, which is registered by the General Pharmaceutical Council (registration number 9010217).  The registered address is:  14-16 Phoenix Business Park, Avenue Close, Birmingham, West Midlands, B7 4NU, United Kingdom.  The pharmaceutical terms are as follows:

Quest HC Ltd will dispense The product(s) on prescription (referred to as the “The Products”) directly against the specification provided to Quest HC Ltd by the referring clinic.  You have been referred to us by the referring clinic on your behalf. Your contractual relationship for The Products is directly with us; Quest HC Ltd will not dispense The Products to anybody on your behalf.

Your medical record, which you have provided the referring clinic is accurate and complete. Your medical record including the issued prescription will be shared by us by the referring clinic and that you are authorising us to share this information.  We need to be informed by you immediately if withdrawal of authorisation is required by you.

We will terminate the Pharmaceutical Terms (including ceasing the dispensing of The Products) in case the relationship between yourselves and the referring clinic is terminated. You allow the referring clinic to inform us of your termination with the referring clinic.

The Products will only be supplied on the basis that a valid prescription has been issued and that the issuing person is a licensed prescriber.  The prescription will be issued based upon a personal consultation and examination. The Products will be supplied to you only for your own use and must not be shared with or used by any other person.

We will ensure that your payment has been received for The Products from the referring clinic; and only then we will dispatch The Products to you.

Upon receipt of the prescription, The Products will be dispensed and supplied to you promptly.  Please notify us if you do not receive The Products within 30 days after the confirmation of your order. You will be the owner of The product once The product has left our premises. We will not be liable for damages suffered due to delay in shipment of The product being damaged whilst on route to you.  

Quest HC Ltd will only accept returns if The Products has been dispensed and supplied incorrectly to you.  

You will use the product in accordance with the directions provided with The Products supplied.  You will inform your doctor and / or healthcare professional in treating you of The Products.  

We exclude (to the maximum extent permitted by law) all warranties and representation, express or implied, in relation to The Products supplied by us, including without limitation implied warranties and suitability for any particular purpose. Your sole remedy in relation to any claims relating to The Products supplied by us is for us to provide a like-for-like replacement.

Any delay or failure in our service due to circumstances out of our reasonable control, including, without limitation, delays due to back orders or issues with postal and delivery services then we shall not be liable.

No rights or obligations under these Pharmaceutical Terms can be assigned to any third party. At our sole discretion, our rights and obligations under these Pharmaceutical Terms can be assigned or licensed to any third party.  No delay in enforcing any right arising under these Pharmaceutical Terms shall be construed as a waiver of such right.

The English courts will have exclusive jurisdiction over any claim arising from or related to them or their subject matter or formation (including non-contractual disputes or claims) of the Pharmaceutical Terms.

We may make changes to these Pharmaceutical Terms from time to time.

Terms of purchase

Prices and Payment

Our listed prices encompass all applicable taxes where appropriate, and we diligently ensure the accuracy of advertised prices. In the event of a pricing error, we are not obligated to fulfil orders at the incorrectly stated price. Should an error occur with your order, we will promptly notify you, affording you the option to cancel. Any payments made will be refunded upon cancellation.

A delivery charge, as indicated on our website, may apply.

We retain the right to adjust product and service prices. In the event of a price increase, we may choose not to increase the price you pay. If your payment is below the advertised price, we may designate it as a 'loyalty price' or equivalent. Unsubscribing or any interruption in your subscription forfeits this loyalty pricing, reverting to the current advertised rate.

Failed attempts to charge your payment card may result in the removal of items from your basket, followed by a payment reattempt.

You assert that the payment method used is yours or employed with appropriate authorisation. Payments are subject to issuer approval, and we are not liable for failed verifications or refusals by the issuer. Suspicious transactions may be reported to authorities. We reserve the right to decline payments without providing a reason. Please note that payment processing takes 2 to 3 days (excluding weekends and bank holidays). Payment method issues may cause delays in MiQuest Product deliveries.

Cancellation Rights

As a consumer, you can cancel your contract within fourteen days of receiving MiQuest Products. To initiate cancellation, log on to your account to cancel the subscription.

If you cancel after product delivery, you must return the MiQuest Products to 14-16 Phoenix Business Park, Avenue Close, Birmingham, West Midlands, B7 4NU, United Kingdom, within 14 days of notifying us. Ensure the products are not damaged during the return.

Sealed goods cannot be returned if unsealed after delivery due to health or hygiene reasons.

Upon cancelation under statutory rights, we will refund the product price and any paid delivery costs, up to the least expensive delivery option. Refunds will be processed using the original payment method.

If you return a defective or erroneously delivered product, we will refund the full price, including applicable delivery charges. You are responsible for return costs otherwise.

Our Liability

Nothing in these Terms will operate to exclude or limit our liability for:

  1. Death or personal injury caused by our negligence.
  2. Fraud.
  3. Fraudulent misrepresentation.
  4. Any matter illegal for us to exclude liability.

The MiQuest Services and Products are provided "as is" and "as available." We provide no express or implied representation or warranty for them, including information or advice. We disclaim all such representations or warranties to the maximum extent permitted by law.

Terms of service

The services we provide to you by MiQuest are bound by these terms (“Terms”) of service.  When you create an account with us and request for consultation then these Terms become applicable.

MiQuest is a medical consultation company.  Based on the information you provide us; we may also recommend prescription and / or non-prescription products for the treatment of your medical condition. You understand that providing us with inaccurate information can lead to your health being affected adversely. The information that you provide us before and during your consultation (including your medical history) must be as accurate as possible and up to date.  It is your responsibility to ask for clarification on any questions which you may not understand.  We will not be liable for any information which you provide that is inaccurate, incomplete or not in date.  It is your responsibility to let us know immediately if the information you have provided changes or it has come to your attention that the information which you have provided us was inaccurate, incomplete or out of date.  You confirm that you are at least 16 years old.  

The MiQuest services that we will provide to you will be within the applicable legal framework.

You are not aware of any reason why we cannot provide you with MiQuest services.

You agree for us to store and use your medical records in accordance with our Privacy Policy.

Our Liability

Payments

MiQuest services operate on a monthly subscription model. Monthly charges for our ongoing recommendations will be processed using your designated payment method(s), and the collection date for payment may vary each month.

All prices provided include applicable taxes, we ensure accuracy in our advertised prices. Upon opening your MiQuest account, you are required to input your chosen payment method and details, confirming that the payment method belongs to you or is used with proper authorisation.

Payments are contingent upon issuer approval. We are not liable if the payment fails verification or is rejected by the issuer. Any suspicious transactions may be reported to relevant authorities. We retain the right to decline payments without providing a specific reason. Please note that payment processing may take 2 to 3 days (excluding weekends and holidays), and issues with your payment method may result in delivery delays.

Your payments for MiQuest Services may encompass consultation and recommendation service fees. These services may not necessarily lead to a recommendation or prescription. If you consent to the Pharmacy providing Medicinal Products, your payment includes the amount owed to the Pharmacy, which we will pay on your behalf.

We retain the right to adjust the prices of our products and services. In the event of a price increase, we may opt not to raise your payment. If your payment is lower than the advertised price, it may be referred to as a 'loyalty price.' Unsubscribing or experiencing a subscription break will result in the loss of loyalty pricing, and your payment will revert to the current advertised price.

The services

To access the MiQuest Services you must set up an online account with us.  Your online account will allow us request information from you regarding your skin concern and medical history via a questionnaire.  Photographs and / or an online consultation may also be required.

In these terms both Prescription Medicines and Non-Prescription medicines are referred to as “Products”.

You agree that our registered prescribers may or may not furnish a prescription for a prescription product for you. This will depend upon the medical information you supply us.  Non-prescription medicines may or may not be recommended to you by us.

In cases where your geographical location or medical condition prevents our prescriber to provide consultation and make recommendation then you will be notified, and a refund will be made if required.

You agree that our prescriber may change your care pathway during or after consultation so that the most appropriate Product can be prescribed.  The prescriber may not furnish a prescription after the consultation and not recommend a product.

The MiQuest service and the products that we recommend to you are for you only and not for anyone else.  The products and the recommendations are tailored to you and is personalised to the medical information we have upon your consent.  You acknowledge that the consultation and / or product recommendation that we have provided to you can adversely affect the health of others.

MiQuest has the right to suspend your account and product deliveries if you do not respond to MiQuest for information request regarding your medical record so that your patient medical record continues to stay up to date or if more information is required.

Any MiQuest services and products that are in breach to the laws and these Terms and if used for any unlawful purpose then we will not be liable for any costs, damages or losses.  

Product delivery

MiQuest will instruct Quest HC Ltd on your behalf to supply you the products upon your consent to Quest HC Ltd following our recommendations from the medical information that you provide us.  MiQuest provides medical consultation service only and does not supply any prescription medicines.  All non-prescription products are supplied by MiQuest.

For the supply of products your contractual relationship is with Quest HC Ltd (please refer to the Pharmaceutical Terms).  You agree to the Pharmaceutical Terms once you have requested delivery of the products.  We will pay Quest HC Ltd the value of the products on your behalf if you consent to Quest HC Ltd in providing you with the products. Quest HC Ltd will dispense and deliver the products directly to you.  The prescription medicine will be supplied to you on the condition that Quest HC Ltd approves the prescription that has been recommended by us.  A valid prescription, following a consultation by the prescriber, must be issued by the registered prescriber to Quest HC Ltd to accept any order for products. You will use the product in accordance with the directions provided with The Products supplied.  You will inform your doctor and / or healthcare professional in treating you of The Products.  

You must stop using any products immediately and contact us if you become pregnant during the use of the MiQuest services.

You must contact us if you experience side effects from any of the products.

You must contact us if your medical information changes or you have started new medication.  

Upon your consent, you agree for us to instruct Quest HC Ltd on your behalf, after our recommendations, to supply the products to you.  All products will be supplied by Quest HC Ltd, which is a registered by the General Pharmaceutical Council (registration number 9010217).  The registered address is:  14-16 Phoenix Business Park, Avenue Close, Birmingham, West Midlands, B7 4NU, United Kingdom.  

Your payment method must be successful and up to date with MiQuest before we pass on your prescription or Product order to Quest HC Ltd.

You consent to us to supply your medication record to Quest HC Ltd, which will continue unless you otherwise stop it.  You can revoke this consent to us by writing to us or Quest HC Ltd, but if you do, then you will not receive any further products.  

Your MiQuest account

It is your responsibility to keep your access details of your MiQuest account secure and confidential. It is your responsibility for any use of your account by anyone else.

At any time and for any reason, we may suspend access to or close your MiQuest account including for non-payment, for abuse of the MiQuest services or for breach of these Terms.

Service Termination

Your MiQuest account will allow you to pause or stop receiving our services.  However, you may still be charged the month’s subscription if we have already begun the monthly payment cycle at the point of you updating your account details instructing us to stop or pause the MiQuest service.

No further consultations or products will be available to you and your account will not be accessible by you if you decide to close your MiQuest account.

To ensure that we are always providing you with the best advice and recommendations we may ask you for another consultation.  We may suspend your MiQuest service if you decline this consultation.  However, we may be able to supply you non-prescription products (which are non-medicinal) if we do not have the complete or up to date medical information about you.  Other reasons why we may suspend your account can be due to the following:

  • Your payment cannot be authorised, or your payment / contact details are out of date;
  • You have breached our Terms;
  • We do not have in stock the product you need, or the recommended product is no longer appropriate;
  • In our professional opinion, the recommended Product(s) are no longer appropriate;
  • The pricing or the description of the MiQuest service is incorrect.
